The party had some minor damage, he paid it himself. Because He has a $13,000 hurricane deductible.
But a separate incident also happen. A neighbor's tree fell on his fence, damaging it , also send branches into his property.
Should he file a claim or clean up the mess himself.

What's his property damage deductible for non hurricane related damage? He may have no choice but to do it himself.

This was due to the hurricane. He has already did the work himself.
Non Hurricane is $1,000. The separate incident with the neighbor tree
Was also caused by the hurricane. Looks like he is out of luck.

I would say so since it would be hard to explain why a downed tree at about the same time was NOT hurricane related.

Yes he is out of luck. Regardless if the tree fell from the neighbor on to his property.
Because he has that $13,000 hurricane deductible, it still applies wherever the damage came from. Just wanted to check with you very intelligence people

Unless the party can show negligence of a dead, diseased or leaning tree AND notification to the neighbor regarding same, the property on which the tree falls will be liable for paying the bill.

Guess he will have to wait, see what his insurance company tells him?
