Almost a month ago I went to court for theft under 5000 and everything went OK,
They give a dervision agreement no criminal record.
But the ather day I got a letter from the store the I did the theft and they want me to pay the damages. Do I have to pay or should I ignore it?

Ignore it, I mean what are they going to do, sue you?

It is now time to settle your debt with the store (re: civil charges).

They are probably asking for more than they should get, or maybe not. If you feel the amount is reasonable, pay it off. If not, don't pay it and when they sue you, go to court.

Second, there was a case in 1997; Hudson's Bay Co v White, that seemed to establish a precedent whereby a retailer could "fine" a shoplifter for damages. However I found a letter from an attorney (see: Letter to Law Firm - response to shoplifting claim for damages (http://www.golishlaw.com/answers/991join.htm)) which seems to contradict that contention. So it looks like your atty was giving you good advice. IF and when the retailer actually tries to take you to court, you can then, engage an attorney to defend against this "fine". Of course, an attorney might cost more than the fine.
