I live in Mauldin, SC, and my boyfriend has lived with me for 9 months. He has paid utility bills during this time, but no rent. How do I evict him? What forms to use? How long to give him to move out?

Is his name on the lease? Have you tried telling him to leave? Are you breaking up with him or do you just want him out of your place?

As Homegirl50 said... Is his name on the lease? If it is you can't. If its yours alone (on the lease).. or if it's a place you alone own, you have to evict him like any tenant. That requires serving him a 30 day notice.. then going to court if he doesn't leave.

Or you can pay him to leave earlier on his own. But do not change locks or put his stuff out or you will be in a lot of trouble as that is considered a constructive eviction and is illegal.

You start giving him a written notice to vacate. This notice should give him 30 days to vacate. You can find such notices with a web search but its simple.

Please be informed that your residence at <insert address> is being terminated effective <insert date 30 days in future>. Please have all your belongings removed by that date. If you have not vacated by the above date, I will be forced to begin eviction proceedings.

If he is not out by that date, then you have to go to your local housing court to start the eviction process. You can visit them to find out the specific process.
