Hi,

I'm not sure if I'm a NR or R tax status.

I came to the US June 1999 to January 2004 as an F1 Visa Student. (still filing 8843)
I changed my F1 Visa to J1 Visa at the end of January 2004 until now Apr, 2007. I worked under my J1 status as a Trainee. I have been paying for both SSN tax and Medical Tax ever since working as a Trainee. My question will be:

1) Should I still filing my tax with 8843?
2) What about my Federal Income Tax? Should I do that with 1040?
3) Will I be able to file a refund for the SSN tax and Medical tax that was withhelded. Form 843?

Please advised,

You are a resident alien for 2006.

1) Form 8843 is not required for you.

2) Yes, use Form 1040.

3) No, you cannot file Form 843 for that refund, because, as a resident alien, you ARE liable for Social Security and Medicare taxes.
