We gave our son a sixty day eviction notice the last of July and should be leaving on 9/30/2015. We understand that if he doesn't leave we are to obtain an unlawful detainer. Where do we get this form and do we file it with our County Courthouse?

Check with your local Superior court. This is where evictions are heard in CA. The process will vary from county to county.

The forms are filed with the court clerk.

After filed, you have a copy served upon the person.
They have 5 days to respond. Time has to be given for post

IF they do not respond, you can file for a default judgement. If they respond a court date is set.

This can take up to 30 days often.

If you win, the person is given 5 days to move. If not, then arrangement with the Sheriff office to remove the person.
