My husband and I were married in December of 2006. He has a 4 1/2 year old he pays support on (obviously, from another women). Can my husband, having to take care of me (not working) and our now 2 year old son, adjust his child support to the other women? Can it be lowered? If so, is it significant? He makes 11 an hour and we can not afford to live on our own. Between him supporting our son, the garnishment of his wages, and me... we are living with his dad. Why does the court not see that they take too much? Can he claim me? Can he claim my son as well? And will my eventual joining of the workforce affect any of this? AHHHHHH!! Why is this world so screwed up and complicated? :mad: ( OK you don't have to answer that last one. I am better now. I live in Arizona, the heat gets to you... :cool: )

Yes, he can have it adjusted at any time. Well at least request to do so. Another kid is a valid reason.

I do not believe the court takes into account that you don't work. That is usually a preference, unless you have a medical reason that prevents you from working this is your lifestyle chioce. My husband Pays a lot of child support, so I searched for a better paying jobmyself to make up the difference. His children need his child support so I will never complain

Each state has its own rules, here the amount the non custodian parent pays is based completely on a percentage of their pay, having more children, having a new wife does not effect what they pay at all. It may in some states.

And the court looks at the needs of the child for the support order.

Also is there a reason you are not working, medical ? Perhaps you can receive disabiility payments if you are not able to work, If you are able to work in today's society it normlaly takes both working to get by now adays

Please state why you are not working, if you don't you may get a lot of negative feed back. Me personally, I would get very upset if I was told that my child support payments needed to be lowered so that my son's father can support his unemployed wife. You went into this marriage and had a child knowing that he had another child that he needed to support correct? So why is it fair to this child for you to say his support needs to be lowered so that your husband can support not just your child but you too? If your reason for not working is not related to a medical condition the only thing I could imagine the judge doing is suggesting that you get a job because "needing to support my unemployed wife" is not good enough reason to take from this other child. Yes the child he has with you will be taken into consideration.
