View Full Version : Does my lease renew without signing

When I moved in to a rental house I signed a lease for 1 year in October my lease was up but stayed there still but never renewed it cause my landlord never brought it to my attention. So in the state of Florida does the lease automatically renew for another year or does it go to a month to month

The wording has to be in the original lease for automatic renewal. If you don't have a copy, have a talk about your status with the owner - IF you don't mind the risk that he or she will decide to raise the rent or something.
If the wording isn't there, you are a tenant at will, and either party can terminate with 15 days notice.

As joypulv stated... it has to be in actual writing in the lease before it will. If it doesn't specifically say it does... then it reverts to what is called a month to month lease. That means they can raise the rent every month if they wanted... or could even give you 15 day notice to leave the property (which is dictated by state law and is longer in most other states). They also aren't required to even offer you a renewal. As far as being notified your lease was up... that's something YOU are supposed to know... they aren't required to remind you.

There is no law that says leases automatically renew. It has to be in the terms of the lease as the others have indicated. There should be clauses that refer to when the lease expires or how its terminated. So you need to read the lease.

The law does say that, at the end of the lease term, the lease will remain in effect as a periodic (month to month) lease. All the terms of the lease, except rental and expiration date remain in effect.

So its up to you whether you are willing to let things remain as is or to request a new lease with a longer term.

It can't renew automatic and even if it is renew you should get the notification of it something which will be prove that lease is renew.

Who says it can't? A lease can certainly have a clause that auto renews if no notice to terminate is issued. And, if such a clause exists, there may be no need for notification.
