In the case where a non-custodial parent's federal tax refund has been intercepted for non-payment of child support, the intercepted funds are generally issued within 30 days after receipt. However, in the case where the non-custodial parent's spouse has filed an injured spouse from to receive their portion of the refund, no monies will be disbursed until after six months have passed, or that IRS has notified the state that the injured spouse claim has been paid, whichever happens first. Generally an injured spouse claim will take 11 weeks if e-filed and 14 weeks if paper filed.

If you have received Family First Benefits, an intercepted tax return will first be applied to monies owed to the state before being distributed. If you have collected more in benefits than the return total, you will not receive any of it.

Please see the Tennessee Child Support guidelines regarding tax intercepts HERE (https://www.tn.gov/humanserv/cs/cs_handbook.pdf), on page 14.
