Hi- I purchased a home about 2 years ago in the state of New Jersey. I am recently having problems with my spouse and contemplating a divorce. While applying for a home equity loan, I found that the house has a lien against a federal case my husband lost a few years after we married. My question is, since the deed and mortgage are only under my name (since his credit score was too low to qualify for the loan) if I move forward with the divorce and am granted full ownership of the house, will the lien be removed or will I own the property with the burden of still having to clear out his debt? Also, who would be the best type of attorney to consult regarding this case a divorce or real estate?

You may need a federal criminal attorney about the lien. In this case because this was "his" residence, even though he did not have his name on the deed, it is possible for them to put a lien on the house because he was doing a criminal activity.

I have just learned that my landlord has my property in foreclosure. I have a one year lease. Have been there for 6 months. When we'll I know when I have to evacuate property and approximately how long does it take for foreclosure proceedings?
