View Full Version : Spouse on F2 but in India, How to apply for ITIN ?

Hello,

I got married on 30th December 2014, so I want to claim my spouse as a dependent while filing my 2014 tax refund. I have prepared the ITIN W7 application but I couldn't get 'certified' copy of her passport from Indian passport office in Mumbai.

My spouse arrives in US for the first time on May 11th which is after tax filing deadline.

Can I send my 1040NR along with a W7 ITIN application signed by her to IRS before 15th April? I can take my spouse to IRS in third week of May to personally verify her passport. Will I be penalized to submit ITIN along with tax refund but without certified passport? If tax refund + ITIN filed before 15th April and Passport verified on end of May, will I get my refund this summer at least?
Or shall I drop the idea of claiming her as a dependent for an exemption and just file as single?

Please advise.

If you owe money, print out Form 4868 and mail it WITH a check for what you owe. That will extend you filing deadline to 15 October 2015.

If you are due a refund, just mail the Form 4868.

Then proceed to the IRS Tax Assistance Center in May as planned.

I am due a refund.

So I shall not be mailing anything before April 15th and 1040NR + W7 will be mailed in May only, is that correct?

Being a non resident alien, can I file form 4868 online or it should be mailed?

As I do not owe anything to IRS, my tax refund is due instead; therefore sections 4, 5, 6, 7 are all should be zero, is that correct?



4 Estimate of total tax liability for 2014 . . $ ( I dont owe anything )
5 Total 2014 payments . . . . . .( I don't owe anything )
6 Balance due. Subtract line 5 from line 4(see instructions) . . . . ( Nothing is due )
7 Amount you are paying (see instructions).. ( Not applicable )

Also fields 8 and 9, they don't apply to me, to be left blank ?
