Okay so almost two years ago in July, we were involved in a car accident. The other driver hit us in a residential zone going between 45 to 50 mph. Our car was totlaed and they were cited for careless driving. There was skid marks from the other car sixty one feet long. Well their car insurance is refusing to pay our medical bills and is only offering my husband and I four thousand for me and five thousand for my husband and five hundred for our son. Our son was only four months when it took place and we are refusing to settle on him, because we don't if something is wrong with him from the accident. I have migranes almost everyday. My husband has a closed head injury. We didn't go to many doctors because we don't have health insurance. We did go to a chiropractor for about a year, and also a regualar doctor a few times. My husband went to a closed head injury speaicalist. My question is do we have a case or not?

Absolutely you have a case from what youv'e said, don't settle on anyone's medical bills until you and your doctors have a grasp of the extent of the injuries as some injuries can last last years or even a lifetime. You don't won't to be left with medical expenses that they (or your company) should have to pay. Did you have uninsured motorist bodily injury coverage on your policy ? It's important to know especially if your or your family's injuries are approaching the at fault party's limits of Bodily injury liability as you may run out his insurance. Also, don't let the statute of limitations run out - if you do, it's all over - you might want to seek the services of an attorney especially on a case like this where there were injuries you described.
