Hello all,

I'm a more than little stressed out over this issue. I am an international student and I graduated from my MA program in May 2014. I'm now on OPT.

Since I did not earn any income, I filed Form 8843 for both 2012 and 2013 with the IRS, on time. The problem is that I lost my own copies and apparently the 8843 is impossible to locate without a 1040NR-EZ.

Does anyone know of any way to obtain copies of the 8843 from the IRS?

Thank you!

You are stressing over a non-issue. The IRS DOES require submission of the Form 8843, but I know of NO case where sanctions or penalties were imposed for failing to submit the form.

You submitted the form. If the IRS cannot find a copy of it, that should give you some indication as to how unimportant it is. Do not sweat it!

Thank you, AtlantaTaxExpert, for your answer. However, I am marrying my US citizen fiancé next year, and we're both supposed to send USCIS copies of our tax returns from the past 3 years when he petitions for my green card.

This is why I want copies of my Form 8843, to demonstrate I've been in compliance with my F-1 visa. I haven't tried submitting the 4506 to the IRS yet, but I'll give that a shot, and see if they can find them for me. If not, what would you suggest I do? The penalty I'm afraid of is not from the IRS, but from USCIS.

Try calling the IRS International Tax Hotline at 276-941-1000.

They may have more luck finding the form in your account than the average IRS employee.

If that fails, then submit the Form 4506.
