Hi evertone,
I have arrived in the U.S. in 2010, then got married in 2013. Last week, I received the W-8BEN from BoA.

As a Taiwanese citizen, do I need to complete the form?
If so, where can I find my "reference number"?
Also, what should I fill in "Supply Reason for US Mailing Address"?

Thanks!

Lee

This is a tax question.

W-8BEN is for people who are considered nonresident aliens for tax purposes. If you are a resident alien for tax purposes, you should fill out W-9 instead. The rules for who is a resident alien are complex and involve how many days you are in the U.S. during the year, etc.

Based on the OP's post, I am going to assume he is a resident alien and is filing Form 1040.That being the case, he should file Form W-9 with the bank.If he IS a non-resident alien, then Form W-8BEN is the correct form to complete for Bank of America.Leave "reference number" BLANK and state uder which visa you are in the U.S. under "Supply Reason for US Mailing Address".
