View Full Version : How could I have failed a test?

I am in DUI Court and had no alcohol at all. A urine test came back from Monday that says I had a 600. I asked them to retest and now may have to spend 8 days in jail because I questioned the test. I even have a breathalyzer on my car as part of my sentence- how can this be when I read all these people who did drink and pass?

Because you were prohibited from ANY use of alcohol ... not just pouring it down your throat (read the fine print). The test didn't lie.. it detected alcohol... and for someone under a restriction.. the source doesn't matter.. alcohol is alcohol. It is an ingredient in a number of products and when it is those are supposed to be avoided as well, in favor of alcohol free formulations... which do exist for almost everything, and thats probibly how and why you failed if you in fact did avoid drinking it (sorry but most alcoholics as well as other substance abusers are less than honest about their problem, the honest ones are rare). Incidently....none of those other uses are an excuse that will get you off the hook.

Those other people... they should all fail... and at some point they will because they refuse to follow directions and continue to drink. If I was in charge, I'd have a policy of getting tested within 12 hours of a notice....if that fell within outside business hours for the test centers, then no later than the next morning before 12 noon. And random tests would be far more frequent.
