View Full Version : Divorce from Bed and Board versus Matrimony

Location is Virginia.

Situation is, I've been separated from my husband for three months now, but because we have children, we are required to wait a full year before we can file divorce. The reason I left was because he was abusive, I had him arrested, and he is actually on a 2 year probation. We were married for 7 years and it took me that long to finally leave, but our marriage has been over for a long time, and I'm ready to move on with my life.

Now, I have recently met up with my first love, and he and I have really hit it off again, all our old feelings have come back to surface and we really want to start dating, however, I would feel bad about dating someone while still married, even though I have been separated.

My question is, would it make sense to file a divorce from bed and board so I can start dating again, and then after that what would be the process to make it an actually legal divorce from the bond of matrimony so I could eventually remarry? How long would I have to wait until I could be officially divorced from the bond of matrimony if I got divorced from bed and board first? Would I have to wait a year from the date of divorce from bed and board, or would it still count from the date of separation?
