View Full Version : Son in Law wants divorce but won't leave your home lives in with your daughter

We bought a house to try to make things easier for our daughter and her family. We asked that they pay enough to cover costs of paying for the house, taxes and insurance. The amount is way below what would be charged renters. Son in law to divorce daughter but refuses to leave the home without formal eviction. There was never any signed agreement and because son in law can't keep a job any months have one by without any payment. His mother lives there and we did not have a problem but her dogs have been allowed to destroy the floors. She has now moved into her third room of the house and the dogs are destroying yet another room. She has now moved in a friend without permission and we found out through the kids. How do we get them out.

Filing for eviction according to the laws of your location is the only way to get them out legally.

Call your local courthouse for the steps used in your area. Meanwhile, write on paper a termination of tenancy for everyone in the house except your daughter. Hand a copy to each of them with witnesses present. State law determines how many days notice they have to be given to leave. After that comes eviction in court, if necessary, and the final step is removal by a sheriff.

Each of those people need to be evicted separately.

That is correct, there is no reason he has to leave and move, until there is a court order. This may be an eviction, or determined in the divorce.

You may be able to get the son-in-law out as part of the divorce proceedings. But that may take just as long as an eviction.
You could try to evict him for non payment which involves a shorter notice period, but not sure if you can evict him separately from your daughter that way.
