View Full Version : I found out there is a lien on my house that I had no idea about.

I'm trying to get a lien removed on my house. I only found out about my divorce attorney's lien when I tried to refinance. I tried to contact her about this but all I got was a bill. I questioned her about charges and received no explanation. This was over two years after divorce was settled. What can I do?

Pay it off... thats why it's there...the lien holder is legally entitled to what they are owed before when the house ever changes hands.

Did the attorney sue you for her fees? It's possible, depending on which state you are in, that an attorney can file an attorney's lien without having to first obtain a judgment, but I believe it is unusual for the law to allow that. So, which state are you in?

Did you not pay your attorney's bill in full? Did you get any dunning notices for the bill?

To have a lien legally, they had to either, have you sign paper work allowing a lien.

Or sue you in court, where you would have received notice of hearings.

So it is impossible for this to happen legally without you knowing.

Since it is an attorney, you will need an attorney. You first research and find out how they lien happened. Go to the courthouse and get a copy of the lien and see when it went to court, and when.

It would appear you did not pay the bill, or set up a payment plan with them.
So yes it is normal for them to do something like this.
