First time parenting time order, mother filed in Az however child and father live in Wa for the past 10 months. We have to answer the filing in Az for parenting time by the 10th of July. We would like to file a foreign judgement/change of venue and have filed our own petition for parenting time in Washington State. My question is in the state of Arizona do you file a foreign judgement or a change of venue?

Is this a part of a previously-determined Arizona divorce or other court action for child custody? If not, I would first question whether the Arizona court has jurisdiction under the Uniform Child Custody Jurisdiction and Enforcement Act (which is the law in Arizona, as well as 48 other states).


But to answer you question, it would be a foreign (i.e.: other state) judgment. Is this from Washington? A change of venue would be moving the case from one place in Arizona to another.

Yes, is there prior court action, of custody orders, from this state.
A Change of venue, would accept the other state had prior venue, which you do ot want to accept.. unless there was prior court cases


If there is no other case, then a motion to dismiss for lack of jurisdiction.
