View Full Version : If rent is less than 15 days late, can I be evicted in the state of Missouri?

I live in Missouri. My rent was due on the 5th. On the 7th, my landlords went and filed an eviction notice on me. Is this legal?

What does your lease say about late payment? Is this the first time?

THey probibly gave you a pay or quit...

If your rent us due on the 5th... that means it must be paid on or before the 5th and its LATE as of the 6th. Its upon you to make sure it gets to them before the 5th.

Yes its legal.

Why didn't you pay it on time...and how many times how you been late.

I will assume... you are normally always late with rent..

Also, normally the rent is due on the 1st and considered late after the 5th.. is that really it or it is really due on the 5th?

But my renters all know... rent is due on the first. I may give them a couple times of being a few days late. If they keep being late. I am at court house on the 2nd.

Of course this is legal... the rent is due, if you do not pay it.. on the exact day due, they can evict you

You can only be evicted if you do not pay the rent by the due date on the notice you received. Your nomenclature is a bit off, so just to clarify, You received a notice to vacate. That notice probably says to pay by x date or vacate. This is known as a pay or quit notice. You have until the due date of the notice to pay in full including late charges or he will then file for an eviction order. This will then require a court hearing before an order is issued.


As Chuck said, is your rent due on the first with a 5 day grace period before a late charge or is it actually due on the 5th? Also, have you been chronically late?
