I filed a form 843 for the overpayment of FICA taxes in 2013. This was as a result of working for two different employers that had the same reporting agent. The common reporting agent appears on both my W-2's and I have aletter from them explaining and confirming the over payment. How long do I have to wait for a refund? I am a US Citizen and the only information I can find is with respect to international folks, not US Citizens.

When Social Security taxes are over-withheld (you cannot over-withhold Medicare taxes), you normally get the excess back when you file your 2013 federal INCOME tax return (Line #69 of Form 1040).

I expect that is the answer you will get from the IRS. You will need to amend your 2013 tax return to get a refund of the excess Social Security tax withheld.

Thank you - I guess I have to wait for a response from the IRS, right? I can't retract the Form 843 filing and submit an amended 1040, can I? I have heard nothing from the IRS but it's only been 2 months since I filed.

Actually, I would amend the return. The Form 843 will be rejected.
