View Full Version : What can I do about all the dust from my nabiors driveway

I live across the road from a campgrounds and they have a stone driveway that causes TONS! Of dust, I have emphysema and it makes it harder to breath with all the dust. We can't open windows in the house because it covers the inside of our house with dust, it also causes my pool to be constantly dirty, our house ,cars everything we own is covered in dust because of his driveway, what can I do about having him fix this problem. I have called and talked to them about it and he has watered it once, that didn't do much after one day other then that he tells me to go in my hat. What can be done about this problem, who can I call to have someone in legal authority to make him fix this problem ? Can anyone help me get answers to my question here?

Sorry but there is nothing you can do... its their property. THere is no legal requirement a driveway be paved. YOU can offer to pay to have it paved if you pay for it... they might accept that offer.. Past that you can live with it or move. Particularly if that campgrounds been there for years.

Hello everyone! Well I need some help here, we live across the road from a campgrounds and there driveway is stone that is causing TONS!! Of dust that just blows over to our place everyday for the past 20 years we have lived here, I have emphysema and it makes it harder to breath, we also can not keep the pool clean without running it constantly witch runs up our electric bill and forget about opening any house windows, the whole inside gets covered in dust not to mention the outside of the house and garage and cars everything gets covered in dust making us having to power wash everything and it will only stay clean for hours before you could do it all over again. I have talked to him about this problem and he doesn't seem to give a crap about fixing it.I'm also disabled and it will cause me a lot of body pain having to try and keep our place clean because of his dusty driveway and not to mention I live on a fixed budget so the extra electric and cleaning bills add up. What can we legally do about this problem?

Posting the same question over and ovewr won't get a different answer. You can't impose a significant expense onto someone else for your own convienience or comfort.

He doesn't have to give a crap... and he doesn't have to pay himself to make changes to his own property because of something you don't like that's perfectly legal.

Was this camprgound there before you bought the house? How many years has this campground been there? Have you offered to pay to have enough of the driveway paved to cut down on the dust?

Sorry if thats not what yuou want to hear....but its their property, and not yours.

Have you talked to your neighbor about the problem, other than the one time at which he told you to "go in [your] hat" (I assume you mean "house")? Perhaps if he knew about your condition he would be willing to do something about the dust. You could also point out to him that treating the driveway (and possibly something short of paving it might be possible) would probably please his customers as well as you.

The dust might possibly be actionable in court as a nuisance, but you would have to consult an attorney in your jurisdiction to see.
