My brother has been on probation for 5 years (over in 60 days). He is going through a nasty divorce and his wife put a protective order against him so that he could not see the kids. He went to court with his lawyer and it was resolved (he was cleared) and he was able to see his kids again. A week later he got a call from a detective who wanted to discuss the protective order and asked him to come in. My brother called his lawyer who told him he did not need to go in because the issue was resolved. The police came and arrested him. He spent the night in jail but was cleared because the officer was not aware of the court decision. The next day he was arrested again because he did not inform his probation officer of his arrest. He has been in jail for three days now and the probation officer is missing in action. Her coworkers say she is supposed to be in but no one knows where she is? They say she is the only one who can release him. What can we do to get him out. He is in danger of losing his job because of this?

My brother called his lawyer who told him he did not need to go in because the issue was resolved.

Big mistake on the part of the lawyer. I suggest you get the lawyer to remedy this mistake by doing what the lawyer can to get this resolved.

The lawyer needs to go before the judge to ask for his release pending a formal hearing. Next a PO has someone that handles his cases when he is not avialable.

The lawyer was the main cause of this, the lawyer should be working on it.

There is no way to get him out, unless the judge releases him, this will happen by the PO or his attorney going before the judge.
