View Full Version : Can a women used my husband's last name on her name to bail him out of jail?

My husband has been having an affair with a girlfriend for a year and a half. He lives with me and children. The girlfriend lives with her family. He goes out with her and drinking a lot and driving around everywhere they like. Yesterday morning my husband and the girlfriend were drinking driving and got pull over by cops for DUI, RECKLESS DRIVING, AND SLOWING THE TRAFFIC. He was going 15mph. The cops cuff him and took him to jail. Both the girlfriend and my husband were drunk. My husband was driving so he had to take into custody or to the Correctional Facilities. When they got to jail the girlfriend bail him out it was a Post Bail which cost her $500.00. The thing is she didn't use her last name while bailing him out but she used my husband's last name on her to let the cops think they are married. My husband and I are STILL MARRIED. I don't know why she didn't use her last name on the receipt.My husband never told me what happened until I went in our car( they were using) and found the 2 tickets and the receipts paid by the girlfriend. I saw her last name using on the receipt was my husband's last name and her name before his last name. Is this illegal?? Should I call my lawyer for her to do this cause she has no right to change her last name while we are still married?

My concern would be if she has a falsified ID. I suppose she could have been ticketed by saying she doesn't have one. Is this the US?
I don't think there's a lot you can do, and you will be wasting money on a legal fee. She didn't use your name; she tacked his last name onto hers. That doesn't make her impersonating you. She could be claiming to be a relative, and it's not your business to complain (he is the one who should handle this). But if it makes you feel better, go to your local precinct and ask them to enter your complaint into the record, so that there is no future blot on your name.
(There's even the outside chance that he married her. It's easy to get away with bigamy. That's between the two of you also. Of course it's illegal, and you could try to have him charged if it's true.)

Anyone can use any name they want as long as there is no intent to defraud. I'm not sure where there could be any fraud here. She may have simply thought it would be easier. So I don't think there is anything to be done about it.
However, I would be seeing your attorney to discuss a divorce. Why are you seemingly incensed about this girl using your husband's last name and not the affair and the reckless behavior? Why are you still with this loser?

She can also, merely go to the court house and change her name, to any name she wishes. There is nothing illegal about a name change.
She can also just lie about her name, unless there are some specific laws, it appears they did not require her to show proof of ID. Unless she has ID with that name.
I agree, why are you upset about the name. That is the least of the issues.
His drunk driving
His having a girlfriend or mistress.
That you are OK with, her using his last name, you are upset.
Sorry you need to get your priorities straight here.
