View Full Version : Recourse in false shoplifting accusation

I'm looking to see my options for recourse if any on a false accusation of shoplifting that resulted in my being marched through my local mall by two police officers.

Monday night after browsing in the Brighton Jewelry shop attempting to redeem a gift card from my husband, I continued my shopping in JCrew. Moments later I was approached in JCrew by 2 police officers who told me the Brighton clerk said I had taken a pair of sunglasses from her store on my head. This was absolutely false. (I entered Brighton with my RayBans on my head, left with my RayBans on my head, and they were still on my head) The officers asked me to go back to the store to see the clerk.

Of course, I walked back across the hall assuming I would find an apologetic (at least) clerk when she realized her gross mistake. Instead I was treated with contempt, received no apology and my questions as to why she would engage police without any justification was met with a blank stare...

I walked out of the store in shock and humiliation and went back to JCrew to thank them for being so nice as this terrible ordeal was happening (and frankly I was so embarrassed that I wanted them to know I had done nothing wrong since I shop there all the time). The staff encouraged me to go back and get their names because what they did seemed so wrong (they actually suggested suing). Calmly I went back asked the other clerk who said she was the manager for both their names. I told her that I had to call her company to let them know how poorly they had handled the situation. She told be to "go ahead" and call human resources. I was now beyond upset and mortified as I realized this had all occurred in my local mall.

I called the Director and Retail Operations yesterday morning and I relayed the story almost to the letter as written above. I made it clear that while I realize mistakes happen I expected at minimum the curtesy of an apology and that I was shocked and horrified to have been treated so badly. This was at 3pm yesterday. She told me that she would do some investigation and call me back shortly. It has been almost 24hrs so I am now doing some "investigation" of my own.

I called mall security to ask about their policy etc. and to report the incident, and I called to get the names of the 2 officer as well from the Police. (they were BTW quite polite and apologetic)

I appreciate your advice.

You understand that some clerks are jerks, but that shoplifting happens dozens of times a day in every store, and the clerk though you had done it,

You were not arrested and it was cleared up, you go on with life, get over it, and have a funny story to tell at the christmas party this year, maybe dress up as a excon for halloween.

Mistakes happen, let it go.

Wow that is horrible! I would keep on the retail operations person that you spoke with! Don't let those girls get away with beging so rude! You deserve at least an apology! I was accused of shop lifting myself as a teen on of my (so-callled) friends was shop lifting and she handed me the bag she was putting it all in and they gab us and took us to the Poloice station I was so scared then the "friend" tried to blame it on me! In the end she confessed and they let me go! I know how embarssing that is! I hope you get those rude girls in trouble!

I sent you an e=mail yesterday about the horrible clerk that checked me out. It was a simple misunderstanding with my handicapped mentally retarded daughter. When we were in the check out line, she asked me if she could buy some ICarly sunglasses. I told her yes I would buy them for her. She was so excited. My Mom was ahead of me in line and when she finished checking out she walked to the door and was waiting for me to finish so I could bring the car up for her. In the meantime this checker left me and went to the last teller where my Mom was standing waiting for me. She grabbed my daughters arm and grabbed the sunglasses out of her hand and told her "your not having these". My daughter started to cry. This checker then came back to where I was checking me out and telling everyone out loud "I just caught a shoplifter". I told her that it was just a misunderstanding that My daughter thought my Mom had paid for them. When I told this checker that it was a simple misunderstanding she continued to THROW MY TOILET PAPER, DOG FOOD AND MY PAPER TOWELS. I then told this checker that she should NOT be working with the public. Then I swiped my credit card and she tossed the slip that I had to sign. So I signed it and then I told asked her why she never checked my signature on my card and license. She just put her nose to the air and ignored me. I do not like that she put her hands on my daughter. My daughter was traumatized for hours later. She kept telling me "Mommy, I no take them". I had a hard time calming her down. I would have figured it out when I seen her that I had not paid for them. We are honest people and this checker made me feel very badly not only for myself but my mentally retarded daughter. I told the clerk, You can see she is handicapped. I will be contacting my attorney regarding this clerk. No one puts their hands on my daughter, No One. My God she has seizures. Asthma. Your clerk was way out of line. And you need to do something with her. She needs to lose her job. I will be telling my friends that have any kind of children, normal or not, from Fargo to Wheaton about what went down in your store and I am sure they will come to the conclusion as I did.. I just want to know why the manager has not contacted me? If he can't handle a customer service complaint regarding one of his workers, why is he still the manager. Here are the numbers on my slip. The date is 8/9/10. ST#4352 OP# 00000443 TE#07 TR# 05399. Please check on this teller and she needs to be in the back with freight not working with the public. I have contacted my attorney and will be waiting for an apology. She traumatized my daughter and will not get away with it.
