I'm looking to see my options for recourse if any on a false accusation of shoplifting that resulted in my being marched through my local mall by two police officers.
Monday night after browsing in the Brighton Jewelry shop attempting to redeem a gift card from my husband, I continued my shopping in JCrew. Moments later I was approached in JCrew by 2 police officers who told me the Brighton clerk said I had taken a pair of sunglasses from her store on my head. This was absolutely false. (I entered Brighton with my RayBans on my head, left with my RayBans on my head, and they were still on my head) The officers asked me to go back to the store to see the clerk.
Of course, I walked back across the hall assuming I would find an apologetic (at least) clerk when she realized her gross mistake. Instead I was treated with contempt, received no apology and my questions as to why she would engage police without any justification was met with a blank stare...
I walked out of the store in shock and humiliation and went back to JCrew to thank them for being so nice as this terrible ordeal was happening (and frankly I was so embarrassed that I wanted them to know I had done nothing wrong since I shop there all the time). The staff encouraged me to go back and get their names because what they did seemed so wrong (they actually suggested suing). Calmly I went back asked the other clerk who said she was the manager for both their names. I told her that I had to call her company to let them know how poorly they had handled the situation. She told be to "go ahead" and call human resources. I was now beyond upset and mortified as I realized this had all occurred in my local mall.
I called the Director and Retail Operations yesterday morning and I relayed the story almost to the letter as written above. I made it clear that while I realize mistakes happen I expected at minimum the curtesy of an apology and that I was shocked and horrified to have been treated so badly. This was at 3pm yesterday. She told me that she would do some investigation and call me back shortly. It has been almost 24hrs so I am now doing some "investigation" of my own.
I called mall security to ask about their policy etc. and to report the incident, and I called to get the names of the 2 officer as well from the Police. (they were BTW quite polite and apologetic)
I appreciate your advice.
