View Full Version : Terminate Lease with Option to Renew

I, as landlord, leased a house to a family 2 years ago. The contract was 1 year contract, but it gave tenant option to renew up to 5 years. After 1 year, I asked tenant to renew contract, but they did not provide any contract nor accept my renewed contract. I assumed the lease become monthly. They did paid every month and I accepted.

Due to number of reasons, I want to terminate the contract and move in the house. Can I terminate it without getting into any trouble? If they provide me a contract after I notify them, do I have to accept it?

I live in Texas.

Give them a written notice that the lease expired by its terms, and because of their failure to exercise the option to purchase before the expiration date, the option also has expired. And, finally, indicate that they must move out no later than a specific date (in most places 30 days from the date of the notice, for a month-to-month tenancy).

No, if the option has terminated they no longer may exercise it.
