Hi,
My husband's account has been frozen by child support. In 2008 the judge ruled in his favor that they can no longer take money from him and they couldn't take his social security. He is on disability and he is getting SSDI. Now, all his accounts are frozen and he does not have any money to live on. He can't pay rent, pay his bills. Can child support do this even though the judge ruled in his favor? What can he do to get his assets unfrozen?

First, you need to find out who initiated the court order to freeze the accounts. Then you go to that court with a copy of the order from 2008 and petition to vacate the freeze order.

Since it is very unlikely that Social Security would have paid any attention to a "freeze order", I assume what has happened is that there was a court-ordered garnishment of his bank accounts, which may include funds received from Social Security and deposited into such account. I am guessing that a judge quashed a garnishment writ back in '08, but someone else in the child support agency again asked for a new writ, perhaps not aware that the judge had already ruled on the issue.

Go back to court and again get the levy quashed.

At the time of the ruling was he in arrears? It may have something to do with that. Also depending on the State the order is through there may be a hefty interest penalty.

It would be best for him to contact the child support agency and try to find out what is going on.
