View Full Version : Lien on a deased parent's credit card.

My mother has passed. Now there is a lien again her credit card wish was dated 2009. I can't sell her property until I can get a release of the lien. She did;nt have assets to cover the lien amount. Also, how long can a lien last. I was in her name ONLY. What can I do ?

First, a lien is an encumbrance against real property that prevents transfer of the property until the lien is satisfied. So you can't have a lien against her credit card. Her credit card issuer may have gotten a judgment against her and used that to place a lien on her property. But that shouldn't prevent you from selling it, you would just need to use the proceeds of the sale to pay off the lien.

When did she pass? Was her estate probated?
