A check came from an car ins. Rebate from our brother who is deceased. No will no ex. I have death cert. and are handling his affairs with no legal actions. It came in the estate of the last name only.. Can we deposit it into my account..

If his accounts are still open then you can deposit the check into an existing account. Then follow the rules of your state for getting the account closed and the money distributed.

I doubt that his accounts are still open, and the bank isn't supposed to accept it. If it's really 'small,' then write 'pay to (your name)' and deposit it and hope that goes through (not supposed to do that either, but it's more likely to not be noticed). Other than that, you have no choice but to probate the estate.

Depending on local laws you may be able to get assign as the personal representative without full blown probate.
