View Full Version : Title company released an income tax judgement to third parties when it was the son

Can a title insurance company release information about an income tax judgement from 18 years ago that was in the same name as the person selling the home and is a direct relative? It stated on the judgement 'satisfied' so not sure why it was released. Does the title insurance company have an liability for releasing that information?

Are you the person incorrectly identified as being the judgment debtor?

Liability would depend on several factors, including:

1. Were you damaged?
2. What is the money amount of your damages?
3. Was it negligent on the part of the title company?

These questions would probably be answered as follows:

1. probably not, unless you were denied credit on the basis of the incorrect report. And this is not likely for a title insurance report because for those the loan would probably already have been approved. The only issue would be whether there is a tax judgment lien which would impair the title. If the judgment has been satisfied, this would not have been a problem in any event.
2. probably minimal at best.
3. considering the facts you have mentioned, I doubt it.
