I just received probation for possession of marijuana (Felony) in Florida 3/7/2014. This is after waiting a decade after being charged with narcotic trafficking ( 25 year min.man). This charge was finally dropped since I was basically entrapped and the police officer went to the prosecutor and asked that he drop these big charges and allow me to accept Cannabis Possession. In my final dispositon, the Judge in Florida wrote that I am able to travel to Las Vegas, NV for work. However, when I presented to the Probation Office that same day, the Probation Officer of "THE DAY" stated I should have received an "administrative probation" given that it had been a decade since my arrest, and that I now lived in Nevada as well as have a medical practice in Las Vegas. I also have always resided in another county in Florida operating another detoxification program for the past 10 years.
So here is the dilemma. I was given a travel permit to travel to Las Vegas to work at my office. (3/7/2014). Probation thought that the Judge would give me administrative probation. My fine attorney left on vacation the day of the plea agreement ( forgot to ask for admin probation as part of the plea agreement) and finally asked through a motion or stipulation for "call-in probation" (3/20/2014). Apparently this was denied, and I must return to Broward County, Fl to be transferred to Brevard County, FL (Melbourne). The reason I know this, I called the lady who gave me the travel permit. She was not there but the Head of Probation, the woman at the courtroom, had major attitude, stated, I should have not gotten a travel permit, and to get myself back there on 3/27, or I would be violating probation. The question: Am I really violationg probation given the Judge's order that I can travel to Las Vegas to work. However, this seems to be a disconnect with a probation department that does not allow trips to anywhere for extended periods. Once I get transferred to another county in Florida, how do I either obtain another motion for admin probation, or ask for a transfer to Las Vegas given I have a home and business there.
I have read your previous comments, but this situation is very weird, and now I feel that I should have not taken this plea given the 10 years of living through hell ( but at least I was not guilty of anything- just could not sleep for 10 years looking at a min/man of 25 years.
I feel because my attorney left that day for a month of vacation and did not bother to explain the plea or the consequences nor ask for admin probation as part of the plea, that I am in this mess.
