View Full Version : Probation officer said no to a transfer to another county.

I have been on probation for almost 3 years, with 4 months to go. I'm currently in a domestic abusive marriage. I also am an addict. I have to move out of where I'm living, because my husband is in jail and we live in his moms 2nd house. She has demanded that myself and my 2 daughters ages 3 and 5 move out. I have family in Payson, Az and a place to stay that is safe. It will also help in my addiction. I currently have a deferred jail sentence to do the last 3 months in jail if I don't comply with addressing my addiction. He told me to go to a shelter. This would be traumatic to all of us. Support from my family is what I need. Who can I talk to above him to get this approved?

Don't go around him, explain the circumstances and ask for reconsideration, outlining why you think this is beneficial for your family. How are you addressing your addition now, and please don't tell us you will start when you can move? From the way it is worded, it sounds like you have 4 months left but can go to jail for 3 months if you don't address your addition.

Ask for an application for change of jurisdiction. Review this procedure and forget his snark. He has a supervisor, find out who that is.

Normally unless you are on some highly intensive level of probation, there is no rule about moving within your own state except notifing them. I would discuss it also with my attorney, who may be able to assist. And as noted, make it a formal request on their forms, so it has to be addressed and answered formally
