I am a custodial parent. I live in WV. My case was turned over to child support enforcement agency in 2009. The father of my children, worked for short period. He worked at a minimum pay job for a year. During my divorce, he was ordered to pay more. However where he worked the minimum pay, child support had to prorate what they could collect from his pay checks. I had to write to multiple managers and finally I was able to get them to file contempt. The contempt case is almost 1 year old. It was re- scheduled 3x already. I work full time and does not receive any state services. My ex husband's family pays for his rent / bills. His car was placed under his brothers name. He builds houses with his mother and his income on paper is nil. Anyone has any thoughts on choices have to go about this.

It appears that you need to get the judge to consider all of these factors to attribute income to your ex, whether your ex "actually" receives it. From what you indicate, it appears that the ex and his family are conspiring to hide his actual income from the court. Hopefully the judge will see through this charade, but (if you don't already have a lawyer) you should seriously consider getting one.

If his family pay his bills that is on them. You can't make his family pay anything to you. As far as his income, how is he paid? Does his mom own a business that he works for? Has he made enough to have to file taxes? His taxes (copies of them) would be what the judge has to go off if he has no regular pay stubs. Also if his brother is willing to let him drive his car there isn't anything you can really do about that.
You already have a court date, so other than getting a local lawyer to go to court with you, you need to make sure you show up at the hearing.

Unfortunately, if a deadbeat dad can hide his income or is willing to work for peanuts, he can beat child support. As stinawords said, his family can pay his bills and lend him a car and there is nothing even a court can do about it.
Your best bet is the home building. If mom has a company and you can prove he works for her and she is not paying him a salary, the court can go after her. But you need proof. I would hire a PI to follow him and get photographic evidence of his doing work for mom.

You can hire an investigator, you can try to show the court that he is living at a life style higher than his income.

Even that won't help if his family is supporting him.
