Ok but what if the child's father is in the picture and always has been, but had to go to work the day we did birth certificate and couldn't give baby his last name? Do we still have to go to court and ask judge? Or what do I do?

Again, father being on, or not being on a birth certificate has nothing to do with child support, It does mean, he would have claimed he was the father in court, or he was proven a father though DNA testing. For child support to be due a court has to order it. To stop court ordered child support, you will need to normally appear back in court.

Just a name change has nothing to do with support being due, or not being due.

Sarah, you have added your question to an existing thread. Due to this there is a bit of confusion as to what you are asking.

Are you needing advice about changing your baby's name or about the father supporting the child? Please add what state/country the child lives in.

First, it's not a good idea to piggyback your question on another thread. To avoid confusion I've moved your post to it's own thread.

When a child is born, the mother is asked for the father's name and what name to give the baby. This information is placed on the birth certificate. So its not up to the father to give the baby his name, it was up to the mother.

If the birth certificate was filed with the wrong info, it usually takes a court order to amend the birth certificate, but it may be possible to make a change without a court order if both parents agree. You need to ask the bureau of vital statistics for your area about the process.

Regaurdless of the status of the father being married or a partner of the mother. When it comes to naming the child the mother has that sole responsibility. If there are any changes to be made because of need then that issue will have to be resolved by the courts once the birth certificate is passed along to the records department.
