Laws vary by state. I would first check with your local city or county children's services. You will possibly have to at least try to contact the birth father.

The how is simple, hire a Family Law attorney to do the job for you. This is NOT something I would attempt without an attorney.

There are 2 caveats here. First you refer to the father of your other child and not a husband. In many areas, only a step parent can adopt, and having a step parent means a marriage. Some areas, however, do allow partner adoptions. A local attorney can tell you the requirements in your area. The second is that you will have to make sure the bio father has been informed of the adoption or at least make a good faith effort to inform him. What this means will vary by area but a local lawyer will know what the courts want.

If you do contact the bio father and he refuses to agree to the adoption, you will have a few alternatives
