View Full Version : What is the statue of limiations on a presonal loan

I loan a young lady 500.00 for her attorney and she stated to me that she would return all monies once she had gotten paid. But to know avail have I seen any moneys for the past 3 going on 4 years can you tell me what my limitations are and if I am able to file at all or if I can bring any charges against this person at all, I'm in the state of Louisiana.

First you can not bring charges, there is nothing criminal here. This is a civil matter. You will need to sue them in small claims court.
What proof of the loan do you have. What proof of amount given is there ?
Is the payment agreement in writing ?

Contact your nearest Small Claims court for a form (if you have proof that it was a loan). There will be a fee of about $50, depending on your state. You are awarded that amount if you win. Getting someone to pay even if you win can also be a problem. Some just ignore the judgment.

If in Ontario, they can't ignore the judgment; wages are garnished for the exact amount.

Louisiana appears to have an unusually long SOL; 10 years (Complete State List of Statute of Limitations on Debt (http://credit.about.com/od/statuteoflimitations/a/entirestatesol.htm)). So you are well within that time frame. So the key will be whether you can prove you lent her the money. If you can sue her in small claims court.
