Hello,

My husband entered US on H1B on December 11, 2006. I entered the country on February 17, 2007 on H4.

Please let me know how does he go about filing the tax for the month of December 2006 as I understand the tax year is calendar year that is Jan-Dec.

What are the forms needed? Does an H4 file tax too? What is ITIN for spouse? Please advise.

He should file as a non-resident alien. Unless he has an extremely high-paying job, it is likely he received only ONE paycheck for 2006 for his U.S.-source income, and his personal exemption of $3,300 will likely offset any tax due.

In 2007, you can file jointly with him and you boht choose to be treated as resident aliens.

Hello, is it Form 1040NR or is it 1040 EZ... yes the income for 18 days is less than $3500. Also what is the standard deduction he can avail of... we are from India. Thank you. Greta.
