View Full Version : How does my Mom get out her adult son who has been living with her?

My Mom went through some health issues and is now residing with me. My brother is living at her home and has been for the last twenty years. She wants to sell her home and we would like to know how to get my brother to leave. He was living off my Mom. She totally supported him because he wouldn't get a job. He only fixed what he absolutely had to in the home. Ie: when the furnace went out he fixed it so he would have heat. My Mom is eighty years old. We haven't tried anything yet because we don't want to do it wrong. He is almost fifty years old and just a deadbeat. He does have an old warrant on him, but we would rather not use that if we don't have to. Even if we do use the warrant to get him out... can the locks just then be changed? I don't think so. Please help!

She evicts him the way she would if she were his landlord. It needs to be done in the locale where the house is, and if you and she are far from there, hire an attorney to do it. First she gives him a notice to vacate within 30 days in writing, which can just be a simple letter of one sentence. She can put the house up for sale any time she wants (although it's best to wait until he's fully out), and a real estate person may be willing to help with the process of eviction. By the time the court process is final it could easily be April, the best time to list a house.

Chances are he isn't going to leave willingly. You can't change the locks until the last stage of an eviction, when a deputy goes out and forcibly removes the tenant.
