View Full Version : Can a landlord enter into your apt with out notice at any time they choose?

Can a landlord enter into your unit just because they have a key without a notice to you at any time of day or night as they choose? They had no reason. I was there asleep on the couch in which they are saying I was passed out on the couch, but that is where I sleep.

Your lease should have it spelled out clearly and you should be given notice of any reason they have to enter your apartment. What specifically does it say, and were you notified they would need access on a certain day?

Does your apartment have a dead bolt that locks from the inside?

If you have no lease, it would depend upon the law in your jurisdiction, but probably no. There would have to be an emergency justifying their entering your apartment without prior notice.

And, of course, whether you were sleeping or were passed out is really none of their business (unless they are claiming it was a medical emergency and they believed you needed medical attention).
