View Full Version : Left USA in 2006 - some dual status return questions

My income was simple - single employer while I lived there, and then I cashed out a small deferred-compensation account after I left. So, I am trying to do this return on my own to save some money, since I don't have itemized deductions.

1. I still have not received my Form 1042-S from the deferred compensation company. Can I file without it? I do have a copy of the distribution check I received which shows the gross and tax wittheld. I will include a note stating why no 1042-S.

2. Can I use 1040NR-EZ, even if I have a 1042-S? Would I enter this amount on line 3 along with my wages?

3. If I need to use 1040NR, on which line do I enter my deferred compensation income?

4. For the dual status statement, do I have to use 1040 vs. 1040EZ? If I have to use from 1040, I assume this is because I am not allowed the standard deduction?

I received my 1042-S, finally, and it answered most of my questions about which forms to use.

However, I am still not sure which deductions to take on the "Dual Status Statement". They are not explicit on how to fill in the 1040. I know this form won't determine the taxes I pay, but I'd hate to have to fill it out again if I do it incorrectly.

So, for the statement, (which is listing my income for the portion of the year I was in the USA only) do I include a regular standard deduction, as if I lived there the whole year? Or do I use only the single exemption as I did on the 1040NR? (my Dual Status Return)

If you are trying to file a dual-status return, then you are obviously IN OVER YOUR HEAD!
