Hi, I would like to know what I can do in my current situation
I am I have an dutch and Israeli citizenship, I entered the us with visa waver
Later on got 2 extensions for my il passport, then dropped out of status, and about a year+ got married to a us citizen, things were good at first, but she didn't let my apply for change of status then she convinced me to find a job illegally, (under the table)
Then at some point things started to go bad between us because I didn't want to be illegal
But she didn't allow me to file.
Then things became unbearable, and she destroyed most of my paperwork
So I won't be able to file, she stolen my dutch passport.
And I am currently am still married to her.
And I can't work, so I don't have money to for anything, lawyers, divorce, filings of any kind, I did go to an immigration lawyer once he told me he can file for battered spouse but because of lake of evidence,
He can't give an easement of what my chances are.
And just to start working on it he wanted 8000, when I just barely manged to get 75$ to go see him.
I currently am hiding from her, (she use to threaten me she is going to get me arrested for being illegal) but kipping in touch because I might need her to sign the divorce documents.
She is already living with an other guy playing house,
(and she is still married to me), I would like to somehow change my legal status if some how possible..
File for a SSN, or for a work permit, driving license, ITIN number so can open a legal
Business through it, just so I can get unstuck, I don't want do things outside of the law

Too late... you are already outside the law being here illegally... and that's going to gravely affect anything you try to do as long as you are. Won't make it impossible...only significantly more difficult.

You can't legally start a business or work here without a work visa of some type (there are various types) or a green card. The ITIN only means you will be paying taxes while being illegal. Which is better than being illegal and not paying taxes.

Besides... just because you married an American didn't give your citizenship... application would have had to been made while you were still llegal... and it still would have taken a lot of time and money with no guarantee it would ever be granted. I personally know people who have been refused... and even had the courts issue a final rulling they never will be... despite American husband and a child born in the usa... they can't even get a green card.

All she would be doing is acting as a sponsor. You can't make her be your sponsor. You would also need her cooperation throughout the entire process which would take at least an additional 5 years before naturalization after and if you are granted a green card.

SO she took your passport... you are aware you can get a replacement from the Embassy of that country? Did you try to get a replacement or just assume you couldn't?

Its about half a mile off Connecticut Avenue....I've been in there a number of times over the years.. I have no idea what the cost is or what forms...but you can call and ask them or Google them up.

Nope. As an Immediate Relative of a U.S. citizen, the OP does not need to be in status to file for Adjustment of Status.

Meant to say legal, not llegal with two LL's... you can make application... but its not handled the same if you are illegal as if you are legal by any means... and leaving the country will eliminate that issue.

Been through that before personally... Wife's status lapsed during the process and I had to get her out of the country to avoid significant delays. Wasn't a flunky at the counter that told me that... this came from very high up in the INS via influential political connections I had. Making application does not change your status either. Not until and unless a green card is issued.
