View Full Version : At fault with uninsured driver

I slide on ice through a stop sign and was hit by another car. Insurances and police report say I am at fault and I only have liability. I got a letter from the other drivers insurance which said he only had death coverage the policy shall not provide liability, collisioin, comp, uninsured or uinderinsured coverage. Insurance is not doing anything for my car. Am I completely screwed or can him not having any coverage someway work in my favor?

Why do you think he should fix YOUR car when YOU were at fault?

You failed to control your car and went through a stop sign. Sounds like you were at fault. So why should the other driver's insurance have anything to do with your damages. And if he was underinsured, that means he can sue you for damages. But your liability insurance should cover that.

If you were underinsured that is your problem.

You were ruled to be AT FAULT... his insurance even if he had it would not have paid to fix your car... thats what liability is... you pay to fix the other guys car (or property) when you are responsible for an accident... but not your own if you were at fault. That's why its cheaper than FULL Coverage. Which if you forked out the extra money to have... WOULD have paid to fix your car. You assume that risk when you take the cheaper option.

Death coverage? Almost every state requires at a minimum Liability insurance. The other person has no liability to you, YOU went through the stop sign and are at fault, even if they hit you. What are you expecting from the other party?

You're screwed even if he had full coverage. You were found to be at fault for this accident, and based on what you wrote, this accident is your fault. So his coverage means nothing, only yours does. Your insurance company will be responsible for paying for his damage. If your policy doesn't cover all of his damage, he can sue you for the money he's out because of your negligence.

Your damages are your problem, not his, or his insurance company's.

You are not "screwed" you are merely at fault. His insurance, even if he had any, would not pay for your car to be fixed, if it was your fault.

You made the choice, by not purchasing collission coverage, that you would pay for your own car repairs, or buy a new car, if yours got wrecked and it was your fault.

This was your choice and now it has happened.
