My mom was killed in a car accident. She had the underinsured motorist policy. It paid out 50000 to beneficiaries. Suppose to be my brother and I, however the insurance companysaid it had to be signed.for by a lawyer and one beneficiary. My lawyer deposited the check into his account after I signed the check and he did and kept $13000 of it and gave me the remainder and said I had to put it into the estate account to pay debts. He said he kept the money for the personal injury protection representation that he did.. I have been waiting 5 months for him to pursue the wrongful death claim. I thought he didn't get paid till end.please help he doesn't help me. Is this wrong

Sounds like two different claims. He would keep his share of the insurance money ( not sure why you used an attorney for this, unless they were not going to pay)

But who is being sued for wrongful death, and the people being sued ? Do they have any money to pay ? If the other people have nothing, and no or little insurance. You may win 500,000 but collect nothing.

It should perfectly correct what the attoreny did

How old are both of you?
It usually takes well over 5 months to settle a claim for wrongful death. Plus, if the party who caused her death was underinsured, that party might not have the means to pay. You could win and never collect. You could be paying this lawyer a lot of money for a very tiny hope.

The attorney won't help you, because he DOESN'T represent you. If I were you, I'd interview a few attorney's who would represent YOUR interests.

Your post is not too clear. Was it her insurance that paid? Who are you suing in the wrongful death. Where did this attorney come from? It is hard to make sense of what you posted.
