Hello,
In July of this year I was put on probation in Gwinnett County, GA for a Simple Assault, with fines, etc. and one of the special stipulations was no alcohol for 12 months.

Sunday I was arrested in Dekalb county, City of Decatur, for Public Intoxication & Trespassing (was asked to leave, then like an idiot, returned to apologize). Court date set in March.

I've told my PO about the situation, and he said I will go to jail when I report.

Aside from being extremely terrified I can not afford an attorney. I have followed all the rules of my probation up to this point and know I can not fight the new charge. Arrested on Public Intoxication and Trespassing.

I am so scared. When I turned my phone on after being released.. I had a job offer, which I had to now turn down. Will I be going for prison or jail for a long time? I have heard horror stories of beatings, rape and even murder in these places and am terrified.

I've been reading all over the net and heard horrible stories where people have sat in jail for over a year waiting for court date. Is there no maximum level of time to wait?

I am willing to do whatever it takes to fix this and am praying for some sort of leniency. I've tried calling the owner of the establishment to apologize, but he is now on vacation. I went to an AA meeting right after getting out on bail and visiting the bondsman.

How will the sentencing there (PI & Trespassing) work with my Probation Violation?

OMG I don't think I've ever been this nervous or scared.

Kind of late for that. You knew you had a stipulation and you knowingly violated it and not only that, you got caught. I would think you will see some time to be served.

Relax.. You'll probably get 15 days in jail for violating your probation, and get fined on your public intoxication beef..

LEAVE the bar owner ALONE. He's NOT your problem.. The PROSECUTOR is the problem and he's NOT your friend.

I agree, maybe 30 days in jail, plus you will not go to prison, even at one year, you serve one year or less in jail not prison. And while there are horor stories in some prisons, most are movies and scare issues, not real life.

You should have accepted the job, if you had a job, at the hearing, it can help, even if you lost it, after wards.

Also, they may just put you on probation after being in jail for a week or two when you go to a hearing.
