I recently found out I am being sued by Capital One for a old cc debt. The sol here in Georgia has expired I believe. A marshall has shown up twice but I did not answer the door. If I am not served the summons can they get a judgement against me? My understanding is they must serve me personally before a judgment could be entered against me. Am I right?

If the SOL has expired, you will win in court, so why bother trying to hide from the Marshall?

If after so many attempts, they will merely do legal notice in the news paper and have a court case without you there. And they will win for sure, since you won't be there to tell them anything,

File notice with the court that granted the judgment, Motion to dismiss lack of proper service, lack of jurisdiction. Look up the court procedure in your state. 98% of all judgment are void due to improper service.
