My name is Angie and I was wondering what rights in the state of Illinois do you have when you are a grandparent or even a great grandparent. Its my sons daughter and he is incarcerated and his girlfriend more than likely will be doing time in jail so I'm just wondering because the other grandmother the baby's moms mom she has felons, drug addicts and chaos in her home so I think it could be a plus I Pray !

What rights are you looking for? If both parents will be in jail, then you can apply for custody. If the other grandparents want to fight it, you will have to show the court the child will be better off with you.

You don't really have any. "rights." As Scott noted, you would have to go to court and petition for custody.
