What if it was the other way around?instead of the father what if it was the mother of the child that could'nt have visition to her child and the father did'nt sign the birth certificate.

Doesn't matter which parent it is. A court orders custody and visitation. One parent is designated the primary custodian, the other the non custodial parent (NCP). The NCP is generally awarded visitation unless there is reason not to.
