View Full Version : F1-OPT-H1B status change: Which tax forms to use?

Hi,
For the calendar year 2006,
I was a student (F1) from Jan 2006 to May 2006.
Then I worked full time on OPT from June 2006 to 24th Oct 2006
Now I am on H1B since 25th October.
I came to USA on f1 Visa in January 2004.
I have been on H1B for about 65 days in the year 2006.
My social security and medicare taxes started after I came on H1B status.
Please advice me what forms to use and whether to file as resident alien or non resident alien.
Is it true that since I have been on H1B for less than 90 days, I can contine filing taxes as a student?
I have been filing taxes since two yrs now because I used to work on campus as a graduate assistant.
Please advice.

You are a non-resident alien. File a 1040NR.

While I agree that you should file as a non-resident alien, you DO have the option of filing as a dual-status alien. It is not likely to be in any way beneficial to you, but it IS an option.
