View Full Version : Suing for Child Support from dad despite her CPS history

Boyfriend's ex wife is threatening to sue for back child support despite father's monetary support throughout the years past as well as taking care of the child during weeks that are scheduled to be with her. He pays for the child'd health insurance, medical bills, school clothing and supplies, etc, yet she is still threatening to sue. She's had CPS called on her twice for domestic violence in the home and drugs being used in the home. She did not test positive but the paramour living with her did. No case was pursued. She also had two previous lovers that beat her up in front of her child. CPS was called in those cases as well. She is a mess, to say the least. Is it possible for her to win child support? This is Texas.

I think you are getting a couple things confused. Child support orders are for money to be paid to the custodial parent. The examples of bad parenting you give have to do with physical custody not anything to do with money. Does she have an order for support right now? If not, of course she can file with the court asking for child support. And she is allowed to ask for it to be adjusted if his income increases or every couple year (I don't remember the exact time frame for Texas). He is also allowed to petition the judge to lower support if the kids are spending more time with him than was in the original order. If he feels that they are not safe living with her he needs to file for a change in physical custody so the children can live with him.
