View Full Version : Infraction deferral agreement

Last week I received a complaint and summons for a traffic violation (78 in 70) this was on I-65 in Boone County. The back of the ticket gives the information for how to pay the fine ($150.00).

This week I received a letter from the Boone County Prosecuting Attorney regarding a Infraction Deferral Agreement. This will cost $172.00 to the Clerk of Boone County and $77.50 to the Clerk of the Thorntown Court.

Not sure what to do, plead Nolo Contendere and pay the fine $150.00, or enter this agreement with the "benefit" of the charge being dismissed after a 12 month period.

I guess I would find out if this ticket would raise my insurance rates - if yes, then I would find out by how much, and if it would cost less to pay the deferral amount...

The other issue is whether a conviction (A nolo contender or "no contest" plea generally amounts to be the same as a conviction) would put points on your license and whether a deferral agreement would not.

Do you also have an option to stand trial. If you have a good driving record, consider that too. I have done so about 5 times over 50 yrs. of driving, and have never regretted doing so. Might be different in your region though.
If this is Boone County KY (there are numerous Boone counties in U.S., you can check other DMV's if not KY), there are no points assessed for less than 10 miles over the speed limit.
My insurance company raises the premium 20% if more than 2 points are accumulated.
