Who has to pay the tenant's attorney?

If eviction gets to the stage of paying an attorney, the court will award those fees as part of the damages against you. Is it too late to forestall all that by agreeing to vacate the premises and owe rent until the landlord can find a new tenant?
I have never heard of a court ordering a tenant to have an attorney. Where is this? Did that really happen? Plus, you tore the apartment up?
